NOTICE is hereby given that under and by virtue of the power of sale contained in the Deed of Trust executed by STAR ROAD PROJECT, LLC in the original principal amount of $1,500,000.00 and recorded on February 21, 2006, in Book 11824, Page 1050, and modified by modification recorded in Book 13376, Page 2339; modification recorded in Book 13859, Page 222; modification recorded in Book 14289, Page 1888; and modification recorded in Book 14871, Page 124, all Wake County Registry, default having been made in the payment in the indebtedness thereby secured by the said Deed of Trust, WAKE FOREST FEDERAL LOAN AND SAVINGS ASSOCIATION, having made demand for sale and a proper hearing having been held before the Clerk of Superior Court on the 6th day of March, 2013, and the Clerk having found that the Substitute Trustee will offer for sale at public auction the property located in Wake County, North Carolina and particularly described as follows:
BEING all of Lots 1 & 2 as shown on Map entitled “Recombination Plat, Property of Aries Group”, recorded in Book of Maps 2003, Page 2003, Wake County Registry.
LESS AND EXCEPT New Lot 3 on map entitled “Recombination for Star Road Project, LLC”, dated July 27, 2006, recorded in Book of Maps 2010, Page 901, Wake County Registry.
Lots 1 and 2 referenced above less and except New Lot 3 also referenced above have been recombined and are now known as follows:
New Lot 1 on map entitled “Recombination for Star Road Project, LLC”, dated July 27, 2006, recorded in Book of Maps 2010, Page 901, Wake County Registry.
Lot 2 shown on map entitled “Recombination for Gordon Munro”, dated July 27, 2006, recorded in Book of Maps 2008, Page 1289, Wake County Registry.
Lot 4 shown on map entitled “Exempt Subdivision Plat for Star Road Project, LLC”, dated July 27, 2006, recorded in Book of Maps 2009, Page 1263, Wake County Registry.
Said public auction shall be held on the 8th day of August, 2013 at 2:00 p.m. in the Salisbury Street entrance of the Wake County Courthouse in Raleigh, North Carolina. At the time of the foreclosure sale, the highest bidder may be required to make a deposit not to exceed the greater of 5% of the bid or $750.00, in accordance with North Carolina General Statutes §45-21.10.
The real property hereinabove described is being offered for sale “as is, where is” and will be sold subject to all superior liens, unpaid taxes, water rents, special assessments and assessments of record, easements and encumbrances of record. Other conditions will be announced at the sale. The sale will be held open for ten days for upset bids as by law required.
Additional notice where the real property is residential with less than 15 rental units:
An order for possession of the property may be issued pursuant to G.S.45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the Notice of Sale, terminate the rental agreement upon ten days written notice to the landlord. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination.
